Teenage Girl Facing Child Porn Charges

http://wearecentralpa.com/content/fu...ews/?cid=69372

A teenage girl in Clearfield County is arrested for child pornography.

A 15-year-old girl from Clearfield County is facing several charges including Possession of Child Pornography, Distributing Child Pornography, and Creating Child Pornography.

Police say the girl took naked pictures of herself and sent them to a 27-year-old man through the popular website “MySpace,” last June.

The Clearfield County District Attorney, Bill Shaw Jr., says even when a teenager takes naked pictures of themselves, it's still considered child pornography and could be a felony.

Shaw says this type of behavior is becoming an epidemic in our region, and that these kids have to be held responsible.
He says when nude and provocative photos are posted to the web, or sent through text messaging, that person could be in some serious danger.
He says they could be stalked, kidnapped, *****, or even killed.

The district attorney and the state police are encouraging parents to monitor their kids use on the internet, and on their cell phones.
The man involved in this case is also facing charges.

This is such a load of fucking bullshit.

CptSternn 02-21-2009 11:56 PM

This is pretty damn near insane. Don't get me wrong, yer man shouldn't have been keeping that sort of thing on his PC, but to arrest a teen and charge them as a pedo when they taken pictures of THEMSELVES seemsa bit daft.

Does this mean everyone in America under the age of 18 should be arrested for being a pedo when they look in the mirror naked? God forbid they change clothes for gym class! Just being in the room would get you life in prison!

But seriously, they are going to put this on a teens record, and force a teenage girl to sign up as a known sex offender on the sex offender registry because she took a naked picture of herself. Something seems extremely wrong with that.

CptSternn 02-22-2009 12:03 AM

I know I mentioned this in another thread, but thought it was worth mentioning again.

I have an uncle who is in prison in America. I sent a some pictures of my new son to him a few months ago. One was my two month old son in his nappie (diaper). The US Prison system sent my post back with a threatening letter telling me that the images I sent were illegal and they were looking into investigating me for sending 'possible child pornography' for sending 'pictures of naked children'.

It was my son, in my sitting room, in his feckin' nappie. But, according to the US government, that is now considered child pornography because they could see 'skin'.

This is like some kind of strange oxymoron. If showing their bodies to people is illegal because of their age... doesn't that automatically imply that we don't consider them responsible? I mean... seriously. If they aren't allowed to take provocative pictures of themselves, but are responsible for their bodies which they aren't responsible for... who's defining the provocation?

O rly, now? How does he not realize that this could happen with anybody who posts any photo?

'A bit'? God, it's fucking psycho. Teenagers have been horny little bastards ever since fucking creation. Technically, it's when people are supposed to mate (not that I think that's right. Nature's intent just doesn't click with modern society).

jack_the_knife 02-22-2009 12:51 AM

And I thought I had seen it all.

Tam Li Hua 02-22-2009 07:02 AM

I don't see why she shouldn't receive punishment. She sent pics of a naked minor to an older man. Even if it's of herself, it's still dangerous, stupid, and illegal.

Because it's going to open the door to all the possible stupid charges discussed above. Shall we also say it's child abuse every time a minor masturbates?

I'm also sure it's probably true about plenty of people who haven't even posted a picture of themselves.

Albert Mond 02-22-2009 01:26 PM

Yeah. I mean, really you're in less danger if you remain anonymous and do porn than if you have no picture at all and have real information about yourself.

If she isn't considered responsible enough to be legally sexual, yet she did it herself, by her own will, what is there to hold her responsible for? If a young girl wears tight jeans, and a guy decides to **** her (by statute or otherwise), is it HER fault? I think tight jeans send a very clear message.

Haunted House 02-22-2009 03:11 PM

Ya know what's funny? A girl could take a naked photo of herself at 11:59 on the eve of her 18th birthday and then take an identical naked photo of herself a few minutes later and one would be child porn and the other wouldn't.

Albert Mond 02-22-2009 03:18 PM

Haha. whitetext

No, not really. If you are under the age of 18 you DO not have many rights, you ARE still a child....and it is NOT appropriate (especially at that age) to be taking pictures like that and sending it to people. It is so incredibly dangerous, and these kids DO need to be held accountable.

Evidently, someone's been arrested for taking a picture of their own tits. The point is whether that action's justifiable, and I think that it's ridiculous. There's a limit to 'saving people from themselves' (I think that the limit is for it not to happen in the first place, but whatever), arresting people for taking pictures of themselves is stepping over that limit.

No, because then she's not being sexual with someone above the age of consent. If the guy she had sent photos to had been a teen as well, I doubt anyone would have thought anything about it. But, since she's sending them to a 27-year-old, it's a bit different.

She's being charged for possession and distribution of CHILD PORN, dumbass.
That's not punishing her for irresponsibility. Plus, the expectation of her having said responsibility obviously wasn't invested in her. Otherwise, she'd have legally gotten away with this.
What's more, you can't charge someone for potentially harming themselves through stupidity.

Given the charges, it's a relevant statement.

Oh GOD FUCKING DAMNIT. Did you NOT READ THE FUCKING CHARGES?
She's being charged for POSSESSION AND DISTRIBUTION of "child porn". It doesn't have SHIT to do with how old the other man was, that's just a shitty excuse for charging her. Also, if she sent it to someone her age, she'd still be at risk of being hurt through it, and the pictures could potentially spread.

Tam Li Hua 02-22-2009 03:37 PM

To clarify, I believe that the point of holding the teen responsible isn't simply that she was being sexual, but rather that she was, in a sense, being sexual with an older man. I watched the vid, and it seems that the local government there are greatly concerned for the sake of their children's safety, which they well should be.

Cpt. Sternn: I don't see why you would send such a pic, when you of all people should have been well-aware of what kind of pics are allowed in prison and which ones aren't, quite honestly.

Ooooooh my God. This is pathetic. All I have to do to derail that sack of shit is remind you that she's being charged with 'child pornography'. It doesn't fucking matter what the context is, if they're charging her with that, it means that the moment she took the pictures she was a criminal.
God. It's fucking simple.

Sternn, did you know what was allowed?

Alarica 02-22-2009 03:54 PM

I could understand it if the girl had taken such pictures of other children, but this is fucking taking the law too far. Seriously. If she wants to take pics of herself and slap them all over the net, then the worst happens and shes attacked. It's her own fucking fault. I have no sympathy. To charge her with 'child pornography' though is ridiculous.

Albert Mond 02-22-2009 03:58 PM

Si, Alarica. If stupidly jumping off a high building only had a 50% death rate, and when they survived you killed them for doing it, it still wouldn't be as idiotic an affair as this.

Damaging her for life because she could have been hurt.

Albert Mond 02-22-2009 04:19 PM

At the very most, she should be confined to a cell in a detention center for an hour or two to think about what she did.
Charging her as a pedophile and a sex offender is criminal.

a morbid curiosity 02-22-2009 05:14 PM

I know a girl who took pornographic photos of herself when she was fourteen and sent them to people.

Nothing happened.

Just goes to show how much of a shithole this place is in regards to that kinda stuff.

Anyway, yeah, I concur that she shouldn't have been punished to such an extent.

Ah, yes. "Because we are concerned about this girl's safety, we are going to not only embarrass her further, but make her name known by considering her a sex offender and having her announce it to all of her neighbors. Again, we are doing this for her safety."

Fuck that.

Tam Li Hua 02-22-2009 06:58 PM

But would she have actually been brought up on charges if these pics weren't sent to an over-aged man?

As far as the good Capt. is concerned, it seems like the kind of thing he -should- be familiar with, if he both has a friend in an American prison -and- has his hand on the pulse of all America's comings and goings as he seems to.

Tam Li Hua 02-22-2009 07:01 PM

Sorry; the chick did something very wrong. If her life is "ruined" [which I seriously doubt it is], then it's her own fault.

YES. The charges are for Child Pornography. If they're trying to charge her specifically because she sent pictures to an older man, then they're using the wrong fucking charges. Again, if you're going to charge her for creation and ownership of it, then she could have been a criminal before she so much as heard of the guy. The only defining factor here is that she got caught with provocative pictures of herself. She also sent them to someone, but the charge for 'Distributing Child Pornography' has nothing to do with the recipient's age. Your shit-brained idea implies that if a child faps off to a child getting fucked in the ass by a fifty year old man (a more obvious and proper example of child porn, and abuse), then it's somehow legal.

You're fucking stupid. Look, we don't know WHAT Sternn was thinking, whether he was, at the time, so aware of America's problems, or whether he even was notified of the rules beforehand. And, plus, let's be honest. As much as Sternn complains about America, he's still no absolute expert on its problems.
Admit it. You're making shit up.

No it's not. She's being charged with something that she shouldn't be charged with. It's like using a flamethrower to give someone a slap on the wrist. I hope you never have to serve twenty years in jail for stealing a candy bar.

Wednesday Friday Addams 02-22-2009 07:09 PM

Tam Li Hua isn't even in the shed as far as tools are concerned.

Xombie 02-22-2009 07:10 PM

No, of course her life wouldn't be ruined. Why would anybody's life be ruined if she was a registered sex offender, having to notify the entire neighborhood after every time she moved, being embarrassed, likely harassed, and ashamed for the rest of her life? Life would be great!

Godslayer Jillian 02-22-2009 07:14 PM

Tam thinks it's justified to have a fifteen year old girl being branded as a child porn distributor for taking a picture of herself naked.
Isn't it about time we send her a collective fuck you?

Xombie 02-22-2009 07:15 PM

Cicero 02-22-2009 07:44 PM

A firm talking-to and perhaps a grounding are in order. Criminal charges? The law is fucked.

Tam Li Hua 02-22-2009 08:19 PM

I'll consider your arguments, discuss it with some other folks IRL, and get back to you folks tomorrow.

Joker_in_the_Pack 02-22-2009 08:33 PM

You know what, fuck this all. You should never be charged with a crime when it is your own body. Fuck that. Should they have given her some sort of penalty for being a dipshit and sending pictures to the older guy? Maybe. The police shouldn't be involved. If her parents grounded her until she was 18, I wouldn't bat an eyelash, but do they not know how fucked she is if she's convicted? She will have trouble finding a job, ever. She'll have trouble moving anywhere, and basically have a huge black spot on her record the rest of her life. Fuck that.

And another thing, I don't believe the police need to protect people from themselves. If you fuck up, you need to own up to your mistakes and take what LIFE throws at you. If that means a creepy stalker, then it's your god damn fault. IF you play with fire and burn yourself you deserved the burn. That doesn't mean you should have some random people set you on fire to teach you a lesson. 15 is damn well old enough to know this is stupid. If they don't, then either there's a serious education failure, or she's a complete dipshit.

Tam Li Hua 02-22-2009 09:15 PM

Perhaps the child pr0n charge is a bit much, after all, but I still think that there should be -some- kind of legal repercussions for the girl. Maybe one night in jail or something. I dunno.

It's kind of a weird case, so it's hard for me to really make a decision about it one way or the other. For instance, if the girl sent the pics and the guy didn't ask for them, then I think that should be handled differently than if he asked for them.

Where is this girl's parents/guardians in all this anyways? What do -they- think about all this?

.

So charging a child as an adult and bring them up on three counts of distributing child pornography is what you consider 'appropriate'?

If they are 'a child' as you say, how is charging them as 'an adult' appropriate?

On one hand you argue they are children and need discipline, on the other hand you think charging them as an adult because they should be punished is ok.

If they are adult enough to go to prison I would say they are adult enough to show off their tits on their webpage.

You can't have it both ways. Either they are a child or an adult. You can't punish a child as an adult for doing something its illegal for a child to do and then expect an adult punishment to stick.

I should know that this:

http://www.flickr.com/photos/cptster...7606580030779/

Is considered child pr0n in America?

What do you think?

I mean seriously, according to the US Dept. Of Corrections, I just posted child pr0n on the internet (actually those have been up for months on my Flickr page, guess that makes me a big child pr0n distributor now).

tekajo 02-23-2009 01:40 AM

Sternn, looks like your kid's not too thrilled about having his picture taken. Maybe he's thinking "I wasn't ready! Look at all this food on me!".

Could it be an isolated incident at your uncle's prison rather than the entire Department of Corrections? Maybe an asshole in charge there?

i've had and currently have several relatives including my little brother in prisons and we've always been able to send pictures of babies very similar to the one you showed us.

Unless they've implemented new policies in the last six months.
