Teen to face trial over stepdad's murder

A Victorian teenager has been ordered to stand trial for the murder of her stepfather who allegedly took nearly 10,000 pornographic pictures of her in four years.

The Shepparton Magistrates' Court was told that on March 13 last year, the stepdaughter shot the 34-year-old in the back of the head to put an end to daily sexual abuse that began when she was 14.

The man's dismembered torso was unearthed in a shallow grave in the backyard of their Mooroopna home on April 9 and further remains were discovered two days later at a campsite nearby at Old Toolamba, in Victoria's north.

The teenager, now 19, has pleaded not guilty to murder.

Her defence barrister Peter Chadwick told the court on the night of his death, the woman's stepfather ordered the accused to go to a shed at the back of their home where he demanded she perform oral sex on him.

Mr Chadwick told the court when the teenager declined, citing a sore throat, the stepfather removed a shotgun from his gun cabinet, loaded it and asked her to rethink her answer.

After she performed the act, she moved behind him and seeing the loaded shotgun lying on the ground, picked it up and fired it at the back of his head.

Mr Chadwick said the woman, who cannot be named for legal reasons, told police her motive for her actions was so "she wouldn't have to do it again".

Under cross-examination, Victoria Police homicide squad Detective Senior Constable Barry Gray said soon after the teenager was charged, police seized a series of still and video pornographic images the deceased had taken of her, which he had stored in the shed.

He agreed while there were many pictures of the pair engaged in sexual activity, "by far the large majority were of just the accused."

He agreed that among the images was one of the accused tied to a chair with cable ties and towels.

Det Sen Const Gray said the images dated from January 2004 until February 2008 and constituted child pornography.

Mr Chadwick told Magistrate Ian von Einem the images cast no doubt on the girl's claims of sustained sexual abuse at the hands of her stepfather.

"It has been videoed, photographed and is clear for all to see," he said.

"He had used the images to blackmail her into submission. Asked by police what she thought would have happened if she hadn't killed him, she said she probably would have killed herself because she could not keep living the way she was."

But Crown prosecutor Mark Gamble said the teenager's dismembering of the body and attempts to cover up the murder, along with forming a relationship with a man her stepfather had banned her from seeing three days after his death, could be construed as something other than self-defence.

"She shot him so she didn't have to do it again... a jury could form the view, albeit against a background of abuse, it was not committed in self-defence," he said.

The accused was ordered to appear at a directions hearing in the Victorian Supreme Court on January 27.

I think anyone who takes 10,000 pictures of their daughter being ***** by them deserves more than a merciful shot in the back of the head. He put her through 4 years of hell, and they're trying to portray him as the victim?!?!! The Justice system failed her. When a Justice system fails that badly it is the responsibility of the citizens to take matters into their own hands.

Can we keep an eye on this court case?

What the fuck? He deserved to be shot. FUCK.

Every time I read one of these, I ponder how many more cases like that there are out there, and my hope for humanity continues to dwindle .

Necrophagist 01-14-2009 07:23 AM

My hope for you continues to dwindle.

You're so predictable...

The bastard got exactly what he needed in my book.

I'm not surprised that the prosecuting attorney takes a stance against the girl. That's his job. I'm pretty certain that the jury will find her "not guilty", since this could be a result of extreme emotional distress.

We'll just have to wait and see, though.

On the other hand, I have to wonder why she didn't simply run away instead of staying long enough to kill the guy, or why she didn't file a complaint with the local police.

I don't blame her for shooting him; I just wonder why she didn't take a less violent and more legal stance against him. [Too scared, perhaps?]

He was blackmailing her into submission by threatening to release all the pictures of her getting ***** if she didn't do exactly as he said. If she went the legal path I have little doubt he would release the pictures.

Necrophagist 01-14-2009 08:58 AM

Exactly. She couldn't have done anything about it.

MegearaErotica 01-14-2009 09:40 AM

I probably would've killed him too, had I been in her place.

Saya 01-14-2009 01:18 PM

I hope they find her not guilty, and she gets all the help she needs to get her life back. I know its the prosecuter's job, but fuck, the poor kid has been through enough.

But, if he released the pics, wouldn't he have been exposing himself?

Not only that...but who would he release them to? If anyone they knew saw the pics, they would know what was up and would [hopefully] call the cops.

It just wouldn't make sense for him to release them.

Then again, emotional manipulation is a -very- strong force, and I can't say I blame her for shooting him.

It doesn't matter if it doesn't make sense for him. It would be very humiliating and tramatic for the girl if he were to release the pictures.

There are plenty of sleezy places on the internet he could post them.

I'm just glad they never did manage to make it to the internet.

Solumina 01-14-2009 04:09 PM

As it was stated the majority of the pictures were just of her, he could have easily released only those pictures so he would not have exposed himself.

Poor girl, I hope that she is able to get the psychological help that I am sure she needs.

Yes, because two wrongs make a right.

Hand Hanzo 01-20-2009 07:06 AM

I can't say I blame the girl, but there's more solutions to that kind of problem then to bust a cap in someone's ass.

There isn't one "victim" and one "perpetrator". They both have made each other the victim of their crime.

Guy molests his stepdaughter, and consequentially gets murdered.

The girl murders the molester, and consequentially gets arrested.

Two wrongs indeed do not make a right.

Joker_in_the_Pack 01-20-2009 07:13 AM

I like you Hanzo.

I want to note that while the guy will forever be viewed as a monster, the girl, who KILLED A HUMAN BEING, will be treated like some sort of fucking hero.

Exactly...the media's gonna blitz this, and put her on a pedestal, just like they do with any other murderer who had something happen to them.

The only justification for killing someone is necessary self-defense. And even then, it isn't justified if the assailant can be subdued without ending a life.

And I like you too.

That's one thing people forget about self defense, it has to be reasonable force. If someone attacks you with a 3 inch pocket knife, you can't fire a .357 round between their eyes and cry self defense.

That's why so many people and I get into fights over Iraq soldiers. They claim, "They only kill in self defense!" No, asshole. If I break into your house, I can't kill you in, "self defense" when you start firing at me.

And that's why I said, if the person can be non-fatally subdued, then it isn't justifable to take a life.
