Are there exceptions for who gets overtime?

Because I asked my boss before labor day if we got paid overtime for it and he said no, because labor day wasn't a holiday, you just got paid regularly. I thought that was just a crappy company policy. Then I got my paycheck today and when I looked through the papers to see that everyone else had signed (I work the front desk so I do all the paperwork) I saw that everyone who worked that Labor Day had a bar that said Holiday pay, but I didn't. Mine was the only one that didn't get paid, and I checked to make sure. The people who weren't there that day had no bar, and then people that were did.

The housekeepers who don't work full time got their holiday pay too, because I checked that as well because I only work 24 hours a week. I've been working here for five months and I thought maybe it only applied after six months or a year but a housekeeper who got the overtime started working two weeks before me.

What is going on?!?!?!?!?!?!

Your boss is a cunt, I suggest setting his house on fire after getting your friends to break his legs.

Pineapple_Juice 09-19-2009 12:39 AM

So in a roundabout way you're trying to say it's illegal?

Still Jack 09-19-2009 12:45 AM

No, not really. Come to think of it, it probably is illegal. In a more serious suggestion, do you have a workers union to turn to, or possibly an ombudsman?

Pineapple_Juice 09-19-2009 05:18 AM

Well, I can call the owner of the hotel, or the Labor Union or whatever, but I'm gonna talk my boss and ask him about it today before I go making a ruckus.

Sounds like a good plan to me. Just don't get yourself fired. =]

Are you over 18? Being under 18 makes the laws a foul mess. If you are over 18 and you are on hourly pay, then you should receive holiday pay. Since you said you live in California, as I remember, you should be receiving time and a half.

It's possible it's just an honest mistake.
Ask about it before you get upset.

Indeed, and if he still dismisses you, it is time to call the cavalry.
In my oppinion, front desk workers are some of the most important workers in the hotel business, so don't feel like you are in any way "less" than your co-workers.

Pineapple_Juice 09-20-2009 02:29 AM

Yeah, I'm 20 so it's not an age thing.
I asked him about it today and he said he'd talk to them Monday and that it was a mistake. I just think it's odd that he'd tell me there was no holiday pay and then have everyone get it but me.
Thanks folks.
