GOTHIC can be taken in different ways. Not just GOTHIC ROCK, or Gothic subculture. If a band uses Edgar Allan Poe lyrics, they can say they have Gothic influences without stepping on your dear bloody subculture.

My complaint is that they're not using it as an adjective, which while annoying, would fall within the bounds you're talking about, and would be technically correct. Although I doubt anyone would actually find them safely within the bounds of the
Gothic Metal genre, even if the genre itself is a debatable topic.
Since they're using it as a noun, then it is obvious they mean it to be "goth," so they're deliberately mislabeling themselves.
