Well, then people will have a choice. Buy it legally with the tax, or take your chances on buying black market without the tax stamp. There's a reason why you don't hear about any ATF busts of untaxed cigarette distribution anymore.
And when it becomes legal, I wouldn't be surprised to see Phillip Morris, RJ Reynolds and the like to jump into distribution. Which would be the beginning of the end for the current underground distribution model. Who wants to risk going to jail for meeting a dealer in some clandestine and potentially unsafe location when you can pay a little more and get it at the local convenience store or possibly even out of a vending machine.
