There is a small town...oh shit, I forget the name but it's somewhere in New England, that the pedestrian always has the right of way. When we went their my mom annoyingly crossed the street and made me take a picture of it because of all that bs.

I'm not necessarily blaming the pedestrians.
I'm blaming people who choose to disobey traffic laws and put themselves and others in danger. If that was the driver, then I guess he is who at fault.
I'm pretty sure you're allowed to drive on the road, though.
