Making acquittals even more likely, the military is prosecuting more contested cases under a controversial law that broadens the definition of sexual assault. Under the 2006 law, the military can argue that a victim was sexually assaulted because she was "substantially incapacitated" from excessive drinking and couldn't have consented.

So in the military, it was legal to have sex with someone too drunk to give consent, when it has met the civilian law definition of **** for thirty plus years now? How is that in any way controversial?

Now you know how it feels! But no. I posted because I read in the army times that army convictions for sexual assault have risen to 50%, where as the other services were lagging by quite a bit. They credited it employing specialist that are knowledgable in whatever the term is for when victims freeze up during the crime, or what happens when they can't remember clearly because of the trauma. But disregard because I left the paper in the tower and can't find the details on my phone. Maybe when I get home.
