Hey, guys...
I can't read so good. Can somebody tell me what this means?
Quote:
Rule 404. Character Evidence; Crimes or Other Acts
(a) Character Evidence.
(1) Prohibited Uses. Evidence of a person’s character or character trait is not admissible to prove that on a particular occasion the person acted in accordance with the character or trait.
(2) Exceptions for a Defendant or Victim in a Criminal Case. The following exceptions apply in a criminal case:
(A) a defendant may offer evidence of the defendant’s pertinent trait, and if the evidence is admitted, the prosecutor may offer evidence to rebut it;
(B) subject to the limitations in Rule 412, a defendant may offer evidence of an alleged victim’s pertinent trait, and if the evidence is admitted, the prosecutor may:
(i) offer evidence to rebut it; and
(ii) offer evidence of the defendant’s same trait; and
(C) in a homicide case, the prosecutor may offer evidence of the alleged victim’s trait of peacefulness to rebut evidence that the victim was the first aggressor.
(3) Exceptions for a Witness. Evidence of a witness’s character may be admitted under Rules 607, 608, and 609.
(b) Crimes, Wrongs, or Other Acts.
(1) Prohibited Uses. Evidence of a crime, wrong, or other act is not admissible to prove a person’s character in order to show that on a particular occasion the person acted in accordance with the character.
(2) Permitted Uses; Notice in a Criminal Case. This evidence may be admissible for another purpose, such as proving motive, opportunity, intent, preparation, plan, knowledge, identity, absence of mistake, or lack of accident. On request by a defendant in a criminal case, the prosecutor must:
(A) provide reasonable notice of the general nature of any such evidence that the prosecutor intends to offer at trial; and
(B) do so before trial — or during trial if the court, for good cause, excuses lack of pretrial notice.

I think this might just be a long way of saying, don't bring up past crimes or the defendant or victim's character unless it pertains to the case. I'm not entirely sure though,

But that's not what Sternn says. At my age, he was taking pre-law and learning how to read good instead of wasting his life going to Iraq and Afghanistan.

Iraq and Afghanistan? Well, that explains why you have a tendency to skew and incorrectly grasp everything you read. I bet Sternn could dissect it all day.
Have you tried hooked on phonics, bro?

Maybe you were, maybe I was, idk I'm just considering another possibility of what he might have been referring to.

This is why I need to get a degree. I heard that you can dissect an article about the law's application of character evidence that's written in plain English ALL DAY with one.

Are you in trouble V?
Just substitute other words for the legal stuff, it's easier to read that way.

Frankly I rather miss the days when our politicians weren't all lawyers, and naturally as lawyers they're also extremely skilled liars. What happened to the day when a common man could be President? to the day when great generals lead not just armies but the whole nation. When a President if he got pissed off could duel the offender to the death(alright maybe that isn't a good thing). Seemed to me those days worked out pretty well, and our generals today all have to be quite skilled with politics. Not saying I would necessarily vote for such a president but I do wonder what happened.

It's oddly perversely funny actually, laws are supposed to be very specific and written out so they're not open to interpretation, but such openness is exactly what the lawmakers seem to be aiming for.

Are you going to law school when you get back to the states, Versus? Or have you already started? Good Luck.
I'd rather dissect a machine any day than tackle the syntax in law, but I think it means that a persons tendencies are allowed as evidence, but not as evidence regarding specific events, unless it a murder case, in which the victim's tendency toward peaceful behavior can be used as evidence that they did not instigate the dispute leading to their death at the hands of the person who is saying they didn't murder them because the victim started it first. Also, these tendencies or traits can be used to suggest/prove the "why" for a crime but not the how... or something to that effect?
Yeah, glad I'm an engineering major.

I know what it means. I'm trolling because I made this thread in response to this:

If you want context for why Sternn is a moron, look at this.

Versus, Cpt. Sternn is an okay guy in his own right, but don't let him get to you, okay. He's just full of himself. (This whole thing kind of puts me in mind of a Reader's Digest article I read back in the Jurassic Era, where somebody had pulled the same stunt on a gentleman at a party, in this case rubbing his nose in the fact that they had a B.S. and a Ph.D. and all he had was a high school diploma. When some other poor schmuck asked him what a B.S. and a Ph.D. stood for, he quipped, "I guess it means his B.S. is piled higher and deeper"). I've always thought of that remark when somebody tries to "out rank" me, and then they can't figure out why I just walk off smiling.
